§ 19-232. Competitive bidding—Conditions; exceptions.

  • (a)

    The director of finance shall call for competitive bids on any public works contract in an amount of five thousand dollars ($5,000.00) or more unless:

    (1)

    The contract is awarded to a person who has been awarded a contract by another public agency through a competitive bid process within the last year, if the unit prices in the city contract do not exceed the unit prices in the public agency contract; or

    (2)

    The director of finance and city manager determine that it is not practical and advantageous to call for a competitive bid. For purposes of this article, the term "public works contract" means a contract to construct public improvements, including, without limitation, streets, alleys, sidewalks, water or wastewater facilities, flood control facilities, traffic control devices, street lighting, parks, public structures and landscaping.

    (b)

    The director of finance shall call for competitive bids for the purchase of tangible property if the contract amount is five thousand dollars ($5,000.00) or more, unless:

    (1)

    The contract is awarded to a person who has been awarded a contract by another public agency through a competitive bid process within the last year, and the unit prices in the city contract do not exceed those in the public agency contract; or

    (2)

    The director of finance determines that it is not practical and advantageous to call for a competitive bid.

    (c)

    The director of finance shall call for competitive bids for the purchase of insurance policies for which annual premiums total five thousand dollars ($5,000.00) or more, unless:

    (1)

    The contract is awarded to a person who has been awarded a contract by another public agency through a competitive bid process within the last year, and the unit prices in the city contract do not exceed those in the prior public agency contract; or

    (2)

    The director of finance determines that it is not practical and advantageous to do so.
