§ 8-3. Zoning.

  • (a)

    Grant of power. For the purpose of promoting the health, safety, morals or the general welfare of the community, the council is hereby empowered to properly zone the city. This shall be done by ordinance which may consider and provide for, but which shall not necessarily be restricted to the following:

    (1)

    Regulation and restriction of the height, number of stories and size of buildings and other structures.

    (2)

    The percentage of lot that may be occupied.

    (3)

    The size of yards, courts, and other open spaces.

    (4)

    The density of population and location and use of buildings.

    (5)

    Structures and areas for trade, industry, residence or other purposes.

    (b)

    Districts. For any or all of said purposes, the council may divide the City of Sterling into districts of such manner, shape and area as may be deemed best suited to carry out the purposes of this Charter; and within such districts it may regulate and restrict the erection, construction, reconstruction, alteration, repair or use of buildings, structures or land. All such regulations shall be uniform for each class or kind of buildings throughout each district, but the regulations in one district may differ from those in other districts.

    (c)

    Planning commission. The council may, by ordinance, create a planning commission to have such duties as the council may provide relating to zoning, land use and land use planning.
