§ 2-298. Approval of certain public improvements by planning commission.

  • Whenever the planning commission shall have adopted the comprehensive master plan of the city or of one (1) or more major sections or districts thereof in accord with the provisions of this article, no street, square, park or other public way, ground or open space, public building or structure, or publicly or privately owned utility shall be constructed or authorized in the municipality or in such planned section and district until the location, character and extent thereof shall have been submitted for approval by the planning commission. In case of disapproval, the planning commission shall communicate its reasons to the council, which shall have the power to overrule such disapproval by a recorded vote of a majority of the council. The failure of the planning commission to act within sixty (60) days from and after the date of official submission to the planning commission shall be deemed approval.
